We are a limited company registered in England under company number 00139076 and with our registered office at Church Street, Eastwood, Nottingham, NG16 3HT.

3. APPLICATION OF THESE TERMS & CONDITIONS

a. These Terms and Conditions of Sale together with our Privacy Policy (view here: Lapierre UK Privacy Policy) will apply to all orders you place and any purchases you make on this website regardless of how you have accessed our website.

b. Please read these Terms and Conditions of Sale carefully before placing your order. These terms tell you who we are, how we will provide products to you, how you and we may change or end the contract between us, what to do if there is a problem and other important information. By placing an order through this website, you confirm that you have read, understood and agree to these terms and conditions.

c. We may occasionally amend these terms and conditions and you should check them each time you place an order. These terms and conditions were last modified on [17th October 2024].

4. OUR PRODUCTS

a. The images of the products on our website are illustrative only. Although we have made every effort to display the products and colours accurately, we cannot guarantee a product’s display of the colours accurately reflects the true colour of the products and your products may vary slightly from those images.

b. While every care has been taken to ensure that product information on our website is correct, actual product, packaging and materials may contain more and/or different information than shown on our website.

c. All product measurements are approximate only and the packaging of the products may vary from that shown in images on our website.

d. You should always read the labels, warnings and instructions provided on or with the products before using them and not rely solely on the information on our website.

e. If you have any queries about the products you have purchased then please contact us using the contact information provided at paragraph 2 above.

5. PLACING YOUR ORDER

a. We reserve the right to impose buying limitations on certain products. This will be notified at the point of purchase. Where it is found these limits have been breached, we may without prior notification, terminate orders that exceed these limits including multiple orders made to the same address, under the same name, or using the same account for payment.

b. You can pay for products using a debit or credit card (Mastercard, Maestro, Visa only). We will take full payment for your order immediately when your order is placed. All transactions are charged in pounds sterling at checkout.

c. You can also pay for products on our website using Klarna. We will take full payment for your order immediately when your order is placed. All transactions are charged in pounds sterling at checkout

d. During the checkout process, you will be asked for your payment details. By completing these you are confirming that the debit or credit card is yours. All card payments are subject to authorisation by your card issuer.

e. If you wish to pay for the products using Klarna, then once you have confirmed your order, you will be redirected to the Klarna login page to complete your payment. If you do not have a Klarna account you can sign up at Klarna login page before completing your order.

f. We reserve the right to withdraw any payment methods at any time and without prior notice.

g. Our standard order processing will see your bike dispatched within 3-5 business days of your order being received. If you place your order on a Saturday, Sunday or bank holiday, the order will be processed and confirmed within five business days for mainland UK.

h. Once you have placed an order, you will receive an e-mail from us acknowledging receipt of your order. However, this does not mean your order is accepted by us. Your order will only be accepted by us once we email you confirming that the products have been dispatched. It is at this point that the contract between you and us for the sale and purchase of your ordered products is formed and becomes binding. The contract that is formed will be in English and will include these Terms and Conditions of Sale.

i. Please note our products are subject to availability. Whilst we will try our best to ensure that our website only displays products which are in stock, this can change quickly and so there may be circumstances where a product you have ordered is unavailable. If we have already accepted your order we will notify you and you will have the opportunity to cancel your order or order a suitable replacement, otherwise we will notify you that we cannot accept your order.

j. We may also be unable to accept your order because:

  • we have identified an error in the price or description of the product;

  • we are unable to obtain authorisation for your payment;

  • you do not meet the eligibility to order criteria as set out in these Terms and Conditions of Sale; or

  • we are unable to meet a delivery deadline you have specified.

We will let you know if this is the case and we will refund you the full amount paid as soon as possible.

k. We may also decide, at our discretion, not to accept an order from you for any products.

6. PRICE

a. The prices of the products will be as shown on our website and in British Pounds Sterling (GBP) including VAT [and all other duties and taxes but delivery charges are extra]. Our prices may occasionally change but (except for any change in the VAT rate (see below) this will not affect any order you have placed before that price change and which we have already accepted.

b. We make every effort to ensure that the correct prices are displayed on our website. However, if we discover an error in the price of the products you have ordered before they are delivered to you, we will contact you to inform you of this error and we will give you the option of continuing to purchase the product at the correct price or cancelling your order. If we are unable to contact you, we will treat the order as cancelled and notify you accordingly.

7. DISCOUNTS, PROMOTIONS AND VOUCHERS

a. On occasion we may offer discounts, offers or vouchers on certain products (the “offers”) e.g. as a promotion or as a gesture of goodwill. We have the right to withdraw such offers at any time and they may also be subject to time restrictions, availability and other terms and conditions.

b. To avoid disappointment, please ensure you check the terms and conditions for a promotional offer before trying to redeem it.

c. We may occasionally provide offers, with or without a promotion code. Offers with codes are usually only valid for one transaction and once the code is used it will be deactivated and will no longer be valid.

d. Offers cannot be added to an order after the order is confirmed, therefore you must ensure that the offer is registered before you confirm and pay for the products (see 5b)

e. We are not responsible for offers related to our products where such offers are published via 3rd party sites or media outlets not directly associated to Lapierre UK.

f. We can withdraw an offer at any time but where you have placed an order using a valid offer we will honour that offer.

e. All discount codes are single-use, single customer offers. Codes cannot be used in conjunction with one another or used on products that are on promotion. If after using this discount code, a customer chooses to return their order, this discount code cannot be used again.

8. COMPETITIONS

a. Occasionally we may offer competitions. We have the right to withdraw such competitions at any time and they may also be subject to time restrictions, availability and other terms and conditions.

b. Competitions may be subject to further terms.

c. We are not responsible for competitions related to our products where such competitions are published via 3rd party sites or media outlets not directly associated to Lapierre UK.

9. DELIVERY

a. Products you order from us will be delivered to the delivery address notified by you at the time of placing your order. We have no liability whatsoever for any products delivered to an address which has not been correctly provided to us.

b. We will use our best efforts to send you your products by the estimated delivery date set out in our email confirming your order, or, if no date is specified, then no later than 30 days following the date of our email confirming your order.

c. If no one is available at your address to take delivery, you will be left a note informing you that delivery has been attempted and that products have been returned to our courier’s premises, in which case, please contact us or our courier to rearrange delivery. Our couriers will attempt delivery up to a maximum of 3 times. You may be charged up to £19.50 for each additional attempted delivery. If all attempted deliveries are unsuccessful you may be deducted a maximum of £35 from your refund due to the failed delivery.

d. If after a failed delivery, you do not re-arrange delivery or collect the products from the delivery depot notified to you we will contact you for further instructions and may charge you for storage costs and any further delivery costs. If, despite our reasonable efforts, we are unable to contact you or re-arrange delivery or collection we may end the contract and we will refund you the money you have already paid for the order but reserve the right to deduct from the refund a reasonable sum as compensation for any costs we have incurred as a result (see 9c ).

e. We are unable to accept orders placed from outside the UK or to deliver to addresses outside the UK. We are unable to deliver to PO Boxes.

f. If we consider that we are or may be unable to supply the products to you within a reasonable time (or at all) we can cancel the contract with you and will refund you any sums that may have already paid us for the cancelled contract.

g. Products that you order from us will be your responsibility from the time we deliver these products to the address you gave us when placing your order. We are not liable for any loss or damage to the goods once they have been delivered to your address and accepted, in accordance with your delivery instructions, including any additional instructions communicated to us or directly to our courier partner (unless caused by our negligence).

10. YOUR RIGHT TO CHANGE YOUR MIND

a. If you are not completely happy with your purchase you can exercise your right to cancel. You must inform us of your decision to cancel within 30 days of receiving your order. The easiest way of doing this is by completing this online form: Lapierre UK Contact Form.

b. Whilst we will endeavour to amend or cancel your order on request once the order has been placed, this may not always be possible. If your order has already moved into our dispatch process, we are unable to amend or cancel orders past this point due to our processing systems. In order to cancel your order that has already gone into our dispatch process, this can be done in accordance with our returns policy.

c. We will issue you with a returns authorisation number. No returns will be accepted without a returns authorisation number and this may affect your refund.

d. Where at all possible, bikes must be returned complete and undamaged. We understand that you may need to test your bike in order to confirm you are happy with your purchase. The product must be returned in a reasonable condition, not exceeding any wear that could be expected for a 30 day period. This will be determined at our discretion on receipt of the returned bicycle. Electric bikes are subject to a 15 mile fair use period. Bikes exceeding this mileage on return will be deducted £5 per mile from the refund.

e. Where at all possible, bikes should be returned in the original packaging to avoid any courier damager in transit back to us. You should pay particular attention to the wheels, forks and frames to avoid damage in transit. Please ensure all original accessories and components are returned with the bike, again in their original packaging. For any bikes returned damaged, missing any accessories and/or components, or having had any accessories or components changed from those originally provided on the bike, we reserve the right to reduce the amount refunded. This could be as much as the full value of the bike.

 f. Where the original packaging is no longer usable and/or available to use to return your bicycle, every effort should be taken to ensure no further damage is possible to the bike in transit. If the packaging is no longer usable, we can provide new packaging for your return, chargeable at £25. Any damage incurred in transit on the bicycles return that has not been raised to us may result in a deduction from your refund as termed in 9(e).

 g. If you are returning the goods within your 30 day cooling off period it is your responsibility to return the bike to us at your own cost. If you would prefer for us to arrange the return please contact our customer service team by completing this online contact form: Lapierre UK Contact Form, or calling 01271 500194. This can be done at a cost of £35 per bike and this will be deducted from any refund due to you. If you ask us to arrange collection for you it is your responsibility to ensure you are available for the courier to make the collection. Failed collections will still be charged, with additional charges being made for each re-attempted collection. This could be as much as £19.50 per failed collection and will be deducted from any refund due to you. We accept no liability for any damage that may occur in transit to a returned bike for which you have arranged your own courier.

h. Your cancellation is effective from the date you notify us that you wish to cancel. You must return the cancelled products to us within 30 days of informing us that you wish to cancel or, if you have yet to receive the products, within 14 days from the date that you receive them.

i. Please note if we supplied promotional items free of charge with the order that you wish to cancel and return, then all promotional items must be returned with the cancelled order items in order to qualify for a full refund. For more information on refunds including our right to make deductions in certain circumstances please see paragraph 11 below.

11. REFUNDS AND REPLACEMENTS

Our 30 day bike returns policy gives you a chance to make sure your new bike is perfect for you. If you change your mind within this 30 day period, simply get in touch with our Customer Service team via phone or email and they’ll help you organise a return. You may return a bike for a refund but we are unable to offer an exchange. For full terms and conditions, see below. If you require us to arrange the return of a non-faulty bike on your behalf we charge £35 which we will deduct from your refund.

To be eligible for 30 day bike returns your order must meet the following criteria:

  • You must contact Lapierre UK and request your return within 30 days from the date of your order being delivered

  • Every effort should be taken to return the bike with all associated parts, including but not limited to; pedals, keys, chargers, baskets, pannier racks, mudguards. Where these parts are missing from the return, your refund may be deducted up to the full value of the bike.

  • For terms on returning your bicycle and packaging, see 9(e). You should pay particular attention to the wheels, forks and frames to avoid damage in transit. Please ensure all original accessories and components are returned with the bike, again in their original packaging. For any bikes returned damaged, missing any accessories and/or components, or having had any accessories or components changed from those originally provided on the bike, we reserve the right to reduce the amount refunded. This could be as much as the full value of the bike.

12. DAMAGED OR FAULTY PRODUCTS

a. If what you have bought is faulty, broken (on arrival) or misdescribed (see paragraph 4 above), please contact us within 30 days using our contact details set out above at paragraph 2. We will (at your choice) either replace or repair the faulty products free of charge or, refund you the price of the faulty products and the delivery charges you paid for the products.

b. You also have the right to terminate the contract where:

  • we have told you about an error in the price or description of the products you have ordered and you do not wish to proceed;

  • the dispatch of the order has been extended without prior notice from ourselves beyond either A) the standard delivery terms, or B) the delivery terms stated at point of order, which ever is longer

  • where we have breached the contract between you and us

c. In any of the circumstances detailed above please notify us by e-mailing us at our contact details set out above at paragraph 2

13. WARRANTY

Certain products that we sell will be subject to a manufacturer’s warranty. For details of which products are subject to warranty, and for the terms of any such warranty, please see here: Warranty

14. DELIVERY

a. For bikes ordered via home delivery our trained mechanics will build your brand new bike and carry out the necessary pre-delivery inspection (PDI) safety checks. When your bike arrives, you will need to attach the ancillary items (such as pedals and baskets) and turn and tighten the handlebars. Instructions and tools will be included in the box.

b. Deliveries will be made to the front of your property. Our couriers will not be responsible for any additional carrying, unpacking or positioning of products. If you order large, heavy or bulky products, you are advised to check that its dimensions (allowing for packaging) will allow it to pass freely through the doorways and corridors of the delivery address (or your car if you choose the Click and Collect delivery).

c. All bikes ordered via click and collect will be built free of charge by your chosen dealer. When your bike is ready, the dealer will contact you to arrange a collection time

e. Any dates quoted for delivery are via our Third Party logistics provider. Please contact the specific provider for delivery updates on your order. Lapierre UK will support in this where requested by the consumer.

15. LEGAL RIGHTS

a. As a consumer, you have legal rights in relation to products that are faulty or not as described. Advice about your legal rights is available from your local Citizens' Advice Bureau. Nothing in these Terms and Conditions of Sale (or our Returns and Refunds policy) will affect these legal rights.

b. If you have any questions or complaints about the products, please contact us using the details set out at paragraph 2 below.

c. We retain the authority to modify the product details featured on this website without prior notice. This includes alterations to equipment, specifications, models, colours, materials, and pricing. In the event of supply chain difficulties, compatible parts may be substituted without prior notice. The prices displayed are the manufacturer's recommended retail prices. The weights of bikes and frames are based on pre-production painted frames at the time of publication and are subject to variation in the final production.

16. OUR RIGHT TO END THE CONTRACT

a. We may end the contract if you break it. For example, where: you do not pay us any sum when due and still do not make payment within 14 days of us reminding you that payment is due, or you seek to order products which you are not eligible to order (for example where the sale is confined geographically or age restricted).

b. If we end the contract in the situations set out in above we will refund any money you have paid in advance for products we have not provided but, we may deduct from that refund or charge you, reasonable compensation for the net costs we will incur as a result of your breaking the contract.

c. We may withdraw the product you have ordered in which case we will let you know in advance and will refund any sums you have already paid in advance for that product

17. OUR LIABILITY

We are responsible for loss or damage you suffer that is a foreseeable result of our breach of any contract with you or our negligence, but we are not responsible for any loss or damage that is not foreseeable. Loss or damage is foreseeable if the loss or damage was an obvious consequence of our breach or if they were contemplated by you and us at the time we accept your order.

We are only supplying the products to you for domestic and private use. You agree not to use the products for any commercial, business or re-sale purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.

We do not in any way exclude or limit our liability for death or personal injury caused by our negligence, fraud or fraudulent misrepresentation or for any breach of any terms implied by law. Terms implied by law include your right to receive products as described, that match their description and any information we have provided to you, that are of satisfactory quality and fit for any particular purpose made known to us.

18. EVENTS OUTSIDE OUR CONTROL

a. We will not be liable or responsible for any failure to perform, or delay in performance of, any of our obligations under these Terms and Conditions of Sale that is caused by an event outside our control (including (but not limited to) strikes, fire, storm, flood or other natural disaster, epidemics, pandemics, or failure of telecommunications networks or impossibility of the use of transport).

b. If we are unable to perform our obligations to you as a result of any event outside our control we will contact you as soon as reasonably possible and we will take steps to minimise the effect of any delay. Provided we do this, our obligations to you shall be suspended for the duration of the event outside our control and we will not be liable for any delay caused by the event. If this affects our delivery of products to you, we will arrange a new delivery date with you as soon as we are able to confirm this but if there is a risk of substantial delay you have the option to cancel the affected order and receive a refund for any products you have paid for but not yet received.

19. HOW WE USE YOUR PERSONAL INFORMATION

We will only use your personal information in accordance with our Privacy Notice a copy of which can be viewed at: Lapierre UK Privacy Notice. Please take the time to read this.

20. OTHER IMPORTANT TERMS

a. This contract is between you and us. No other person shall have any rights to enforce any of its terms.

b. We may transfer our rights and obligations under any contract with you to another organisation with prior communication and approval with you before this happens. You must not transfer any of your rights and obligations under any contract

c. Each clause of these Terms and Conditions of Sale are separate and if any court or relevant authority decides that any of them are unlawful or unenforceable, the other clauses will remain in full force and effect.

d. If we do not insist that you perform any of your obligations under these Terms and Conditions of Sale, or where we do not enforce or delay enforcing our rights, that will not mean that we have waived our rights nor that you do not have to comply with those obligations. If we do waive a default by you, we will only do so in writing, and that will not mean that we will automatically waive any later default by you.

e. These Terms and Conditions of Sale are governed by English law and the English courts shall have non-exclusive jurisdiction to hear any dispute or claim arising out of or in connection with these Terms. This means you may bring a claim to enforce your consumer protection rights in connection with these Terms and Conditions of Sale in England or if you are a resident of Northern Ireland you may also bring proceedings in Northern Ireland, or if you are a resident of Scotland, you may also bring proceedings in Scotland.

We try to ensure that information on our websites is accurate, complete and up-to-date. In using our websites, however, you agree to be bound by the Terms & Conditions, which take effect on the date when you place and order with us

22. TUNING OF ELECTRIC BIKES

Important; Please be aware that this bike is regulated in line with existing Electric Power Assisted Cycles (EPAC) regulations. Any modification to the bike will invalidate the guarantee and in particular any modification which increases the power of the motor and/or the top assisted speed of the bike may make the rider liable to prosecution. Excluding statutory obligations Raleigh will not be held responsible for any injuries incurred following any modification to this product.

23. MAINTENANCE AND SERVICING

It is your responsibility to ensure that your bike undergoes regular inspections as detailed in the Original Operating Manual provided with your bike. The intervals between inspections depend upon the distance/hours/conditions of use. In the event of warranty claims we reserve the right to check whether the fault which occurred could have been avoided through proper maintenance. Depending on the result we reserve the right to reject the warranty claim.

24. EBIKE BATTERIES

Please refer to the battery manufacturer’s guide for information pertaining to the maintenance of your Ebike battery to ensure it is stored, charged and maintained correctly. In the event of warranty claims we reserve the right to check whether the fault which occurred could have been avoided through proper maintenance. Depending on the result we reserve the right to reject the warranty claim.

25. BIKE WEIGHTS

Where possible we have included the bike weight within our product specifications. The weight provided is an approximation and will vary depending on the size of bike purchased as well as other factors.

26. COPYRIGHT

By accessing www.lapierrebikes.com/gb-en and the other Lapierre UK official websites or any of their web pages, you unconditionally agree to the terms of this Copyright Statement and as they may be modified and/or supplemented without prior notice to you. Please, check this webpage regularly for any modifications and/or supplements which may be made.
